Terms and Conditions

This is a translation for your information. Only the German version (www.giselabacke.com/agb/) is legally binding.

1. Scope

(1) These Terms and Conditions apply to all contracts between

Gisela Backe

Coaching & Design
Ettlinger Straße 25
68239 Mannheim
Germany

Email: ma**@*********ke.com

(“I”, “me”) and you as a client or customer. They apply to consumers and to businesses.

(2) A consumer is any natural person who enters into a contract for purposes that are mainly outside their trade, business or profession (Section 13 German Civil Code, BGB). A business is anyone who acts in their trade, business or profession when entering into the contract (Section 14 BGB).

(3) Different terms only apply if I have expressly agreed to them in text form. Individual agreements (for example in an offer or an order confirmation) take precedence over these Terms.

(4) The contract language is German. This English translation is for your information only. If there are differences, the German text applies.

2. My services

(1) I offer:

  • Coaching: single sessions (for example “What Really Fits”, 90 minutes), short sessions (for example “Wind at Your Back” and “One Word for You”, 30 minutes each) and longer coaching journeys. In person in Mannheim, by video or by phone.
  • Wind at Your Back: On the Road: personal companionship on a special day (for example a talk, an event or a trip), with a preparation call and, depending on the package, an overnight stay and a debrief.
  • Jewelry design: bespoke pieces made to your wishes, including logo jewelry.
  • One-of-a-kind pieces: finished jewelry, art cards and art prints.
  • Personal “Silver & Fire” workshops: for one or two people, by arrangement.
  • Coaching through an education provider (for example with an activation and placement voucher, AVGS): here the terms of the provider and the voucher take precedence.

(2) What exactly a service includes is described on the relevant page at www.giselabacke.com, in my offer or in our written agreement.

(3) Free introductory and consultation calls (usually 20 to 30 minutes) are non-binding. They don’t oblige you to book anything.

(4) Purchases in my Etsy shop are governed by Etsy’s terms and my shop policies on Etsy. Offers from other providers are governed by their terms.

3. How the contract is made

(1) The offers on my website are not yet a binding offer, but an invitation to book or to ask.

(2) Online booking through my booking calendar: you choose a time, enter your details and pay. By clicking the booking or payment button, you make a binding offer. The contract is made when you receive the booking confirmation by email.

(3) Booking by email, phone or messenger, and jewelry commissions: I send you an offer or a summary of the service with the price. The contract is made when you agree and I confirm the order in text form (for example by email).

(4) You can read, save and print these Terms at any time at www.giselabacke.com/agb/. I also send them to you with the confirmation.

4. Prices and payment

(1) All prices are final prices in euros and include German VAT (currently 19%). For goods, shipping costs are added (see section 8 (5)).

(2) Sessions booked online are paid directly when you book in the booking calendar (Brevo). Payment is processed by the payment provider Stripe; Stripe’s terms also apply.

(3) I send invoices by email. They are payable within 14 days without deduction, unless agreed otherwise.

(4) Longer coaching journeys: we agree the price, number of sessions and payment (in full or in installments) in writing beforehand. The first payment is due before the first session.

(5) Bespoke jewelry and logo jewelry: when you place the order, you pay a deposit of 50% of the agreed price, unless my offer says otherwise. It mainly covers the material. You pay the rest when the piece is finished and before I ship or hand it over.

(6) Wind at Your Back: On the Road: when you book, you pay 50% of the package price. You pay the rest no later than 14 days before the date. If you book less than 14 days before the date, you pay the full package price when you book. Travel, accommodation and meal costs and other expenses (for example tickets) are added unless they are expressly included in the package price. We agree on them beforehand.

(7) If you are late with a payment, I may hold back further services until the payment due has arrived. The statutory rules on default apply.

5. Appointments, cancelling and rescheduling (coaching)

(1) Appointments are binding. If something comes up, please let me know as early as possible, by email to ma**@*********ke.com.

(2) For coaching sessions (including 30-minute sessions):

  • Cancelling or rescheduling up to 48 hours before the appointment: free of charge.
  • Less than 48 hours before: 25% of the price.
  • Less than 24 hours before: 50% of the price.
  • If you don’t show up without cancelling: 100% of the price.

(3) You may always prove that I suffered no loss or a smaller loss.

(4) If I have to cancel an appointment, for example due to illness, we find a new date. If that isn’t possible or reasonable for you, you get back in full what you already paid for that appointment.

(5) In longer coaching journeys, agreed sessions you haven’t used don’t expire without notice. We write down in our agreement within which period the sessions take place.

(6) Your statutory right of withdrawal (section 10) remains unaffected.

6. Wind at Your Back: On the Road: cancelling and special terms

(1) If you cancel a booked companionship:

  • up to 30 days before the date: free of charge,
  • 29 to 8 days before the date: 50% of the package price,
  • from 7 days before the date: 100% of the package price.

Booked too fast? If you cancel within 24 hours of booking and the date is still at least 3 days away, cancelling is free.

Section 5 (3) applies accordingly. Your statutory right of withdrawal (section 10) remains unaffected.

(2) Travel and accommodation that I have already booked at your request and that can’t be cancelled free of charge are paid by you in addition. I only book them after agreeing with you.

(3) If I can’t accompany you for an important reason (for example illness), I let you know right away. We look for a new date. If that isn’t possible, you get back everything you paid me for that date. I only reimburse further costs (for example your own travel or tickets) if I caused the cancellation intentionally or through gross negligence.

(4) I accompany you as a confidante and ally. Wind at Your Back: On the Road is not a security service, not a transport or travel agency service, and not medical or psychological care. You are responsible for your own travel bookings, luggage and valuables.

(5) Conversations during the companionship are included. If you’d like planned coaching sessions, we book them separately.

7. Coaching: important notes

(1) Coaching is a free, active process in which you make your own decisions and take your own actions. I accompany you with full attention. I can’t promise, and don’t owe, a particular result.

(2) Coaching is not psychotherapy or medical treatment and doesn’t replace them. I don’t make diagnoses or give medical advice. Coaching requires normal mental and physical resilience. If you are under medical or psychotherapeutic care, please talk to your doctor or therapist first. I may end a coaching if I feel treatment is needed; you then get your money back for sessions that haven’t taken place.

(3) I treat everything you share with me confidentially, also after our work together ends. This doesn’t apply where I am legally required to disclose information.

(4) For video or phone sessions, please make sure you have a working connection and a quiet place. I send you the link (for example for Zoom or Google Meet) beforehand.

8. Jewelry: bespoke pieces, logo jewelry and one-of-a-kind pieces

(1) Design: we talk about your wishes. I make sketches and give you a fixed price. I start after your approval. Usual making times are 3 to 6 weeks. If you need your piece by a certain date, please tell me before you place the order; we then put the date in writing.

(2) Handmade: every piece is made by hand and one of a kind. Small differences from the sketch, photo or sample in shape, surface and color are part of it and are not a defect.

(3) Logos and templates: if you give me a logo, image or text as a template, you confirm that you are allowed to use it for this purpose (for example because it’s your own logo or the owner has agreed). If third parties bring claims against me because of it, you indemnify me, insofar as you are responsible for the infringement.

(4) Photos of your piece: I only show your piece or your logo publicly (for example on my website or on social media) if you have agreed.

(5) Shipping and handover: I ship insured and with tracking. Shipping costs: Germany €7. For shipping abroad, I state the cost in my offer, depending on the country and the value of the piece. By arrangement, you can also pick up your piece in Mannheim. For deliveries outside the EU, customs duties and import charges may apply; they are paid by the recipient. I can’t influence delays caused by customs.

(6) Retention of title: the piece remains my property until it is paid in full.

(7) Defects: the statutory warranty applies. Please get in touch if something isn’t right. Because one-of-a-kind pieces can’t be replaced with an identical one, we find a solution together: repair, a newly made piece or your money back.

9. Personal “Silver & Fire” workshops

(1) We agree the content, date, place and price individually and put them in writing. Material, snacks and drinks are included unless agreed otherwise.

(2) If you cancel a workshop: up to 14 days before, free of charge; 13 to 4 days before, 50%; from 3 days before, 100% of the price. You can pass your place on to someone else free of charge up to one day before. Section 5 (3) applies accordingly.

(3) In the workshop you work with tools, a kiln and an open flame. Please follow my safety instructions. For valuables you bring, I am only liable under section 11.

10. Right of withdrawal

(1) As a consumer, you have a statutory right of withdrawal. The details are in the withdrawal information below and at www.giselabacke.com/widerruf/.

(2) There is no right of withdrawal for goods made to your personal specifications, for example bespoke jewelry and logo jewelry (Section 312g (2) No. 1 BGB).

(3) Services (coaching, Wind at Your Back: On the Road): if you’d like me to start before the 14-day withdrawal period ends, you confirm this expressly when you book. If you withdraw after that, you pay a proportionate amount for what I have already provided. Once the service has been provided in full, your right of withdrawal expires if you expressly agreed beforehand and confirmed that you know this.

(4) You can also withdraw online, quickly and easily: use the “Withdraw from contract” link at the bottom of every page of my website (www.giselabacke.com/withdraw-from-contract/). I confirm receipt of your withdrawal by email right away.

(5) Returning goods: please send goods back well packed, insured and with tracking, and send me the tracking number. That way I can check the return and refund you faster.

11. Liability

(1) I am liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

(2) For slight negligence, I am only liable if I breach an essential contractual obligation (an obligation whose fulfillment makes the contract possible in the first place and on which you may rely). My liability is then limited to the typical, foreseeable damage.

(3) I am not liable for technical problems during video sessions that are not my fault. We then reschedule the session.

12. Copyright

My designs, sketches, texts, photos and materials remain my intellectual property. You may use them for yourself. Passing them on or using them commercially requires my consent in text form. A logo you give me as a template of course remains yours.

13. Data protection

How I handle your data is described in my privacy policy: www.giselabacke.com/privacypolicy/

14. Dispute resolution and final provisions

(1) I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer whose habitual residence is in another country, you keep the protection of the mandatory consumer protection laws of that country.

(3) If you are a business, the place of jurisdiction is Mannheim.

(4) If any provision of these Terms is invalid, the remaining provisions remain valid.

Withdrawal information

Based on the official EU model (Annex I of Directive 2011/83/EU).

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires after 14 days

  • for services (for example coaching): from the day of the conclusion of the contract,
  • for goods: from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform me

Gisela Backe, Coaching & Design, Ettlinger Straße 25, 68239 Mannheim, Germany, phone: +49 621 15954423, email: ma**@*********ke.com

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, I shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by me), without undue delay and in any event not later than 14 days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

For goods: I may withhold reimbursement until I have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to me without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to me. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

For services: if you requested to begin the performance of services during the withdrawal period, you shall pay me an amount which is in proportion to what has been provided until you have communicated to me your withdrawal from this contract, in comparison with the full coverage of the contract.

Exclusion or early expiry of the right of withdrawal

There is no right of withdrawal for contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (for example bespoke jewelry and logo jewelry).

For a service contract, the right of withdrawal expires when I have fully performed the service and only began the performance after you gave your express consent and at the same time acknowledged that you will lose your right of withdrawal once the contract has been fully performed.
